Department of Defence – Safeguarding Australia’s Military Secrets Consultation on Updates to the Determination

The Department of Defence is seeking feedback on proposed amendments to the Defence (Non-foreign work restricted individual) Determination 2024 (the Determination), part of the Safeguarding Australia’s Military Secrets (SAMS) legislative framework.

The SAMS framework helps protect sensitive Defence knowledge and capability by managing risks associated with the transfer of military expertise outside Australia.

The proposed amendments will help ensure the Determination remains fit for purpose by clarifying how job family roles and time elapsed provisions apply to former Defence personnel, and by reflecting current workforce structures.

Stakeholders are invited to review the consultation paper and provide feedback using the template within the consultation paper and submit by email to sams.policy@defence.gov.au by 5 pm AEST, 17 August 2026.
